| Resumo : | A União Energética representa um dos mais ambiciosos projetos de transição ecológica, política de segurança energética, e de integração dos sistemas de energia do mundo. A criação da União Energética foi resultado de intensas negociações entre as instituições da União Europeia. Entre as principais instituições estão a Comissão Europeia e o Conselho da União Europeia. Buscando entender melhor as interações entre esses dois atores, esse trabalho analisou as legislações propostas pela Comissão Juncker (2014-2019) para a criação da União Energética. Essa análise foi feita utilizando o Intergovernamentalismo Liberal, a Teoria dos Atores com Poder de Veto, teorias de burocracia, e o conceito de spillover, para examinar o direito comunitário acerca da energia. Esse trabalho conclui que a Comissão Europeia é um ator com poder para influenciar e mudar o resultado das legislações europeias. Apesar disso, o Conselho da União Europeia aparenta ter maior capacidade de determinar a legislação final. |
| Abstract: | The Energy Union represents one of the most ambitious projects of ecological transition, energy security policy and integration of energy systems in the world. The creation of the Energy Union was the result of intense negotiations between the institutions of the European Union. Among the main institutions are the European Commission and the Council of the European Union. Seeking to better understand the interactions between these two actors, this work analyzed the legislation proposed by the Juncker Commission (2014-2019) for the creation of the Energy Union. This analysis was made using Liberal Intergovernmentalism, Veto Power Theory, theories of bureaucracy, and the concept of spillover, to examine the community law about energy. This work concludes that the European Commission is an actor with the power to change and influence the outcome of European legislation. Despite this, the Council of the European Union appears to have a greater capacity to determine the final legislation |
