O direito a ter direitos em A hora da estrela : uma análise dos direitos humanos sob a luz de Hannah Arendt

Abstract

Considering that Brazil has millions of Brazilians living in poverty and below the poverty line, and that human rights have historically been denied, an investigation is carried out on “The right to have rights in A Hora da Estrela: an analysis of rights human rights in the light of Hannah Arendt”, in order to analyze how A Hora da Estrela, a novel by Clarice Lispector, can contribute to thinking about human rights through the prism of Hannah Arendt. Therefore, it was necessary to analyze: I) how law and literature intertwine related to human rights; II) what are the human rights denied to Macabéa in A Hora da Estrela; III) what is Arendt's thinking on human rights. A research is then carried out using the phenomenological method, with a qualitative character, through the bibliographic review technique. Therefore, the following results are verified: I) human rights can only be materialized within a solid democratic regime and art-literature is intertwined with human rights and democracy by enabling culture, criticism of social inequalities and freedom of thought ; II) in the Claritian novel, Macabéa, being a woman, poor and migrant from the Northeast, suffers the pain of social invisibility and has numerous human rights denied, with the absence of dignity and the absence of a place in the world; III) Hannah Arendt criticizes the classic view of human rights when she says that people are not born equal in rights, but equality can only be a construction, the human right is first the right to be the subject of rights, and this enables everyone other human rights; which imposes the observation that A Hora da Estrela contributes to thinking about human rights in the light of Hannah Arendt due to the fact that it presents a narrative of social criticism whose protagonist is a woman, poor and migrant, as out of place in the world as the displaced people approached by Arendt. Macabéa, therefore, despite being formally a citizen, materially, was not considered a subject of rights.
