Direito dos animais : uma análise sobre a efetivação da proteção à crueldade animal no estado de Sergipe

Abstract

Throughout history, as the way human beings see the world changes, their perception and relationship with the environment also changes. From an anthropocentric view, according to which the human being is the most important factor in the Universe, man moves to ecocentric thinking, which says that the environment is the main character. Although the Federal Constitution of 1988 and other Brazilian laws guarantee the rights of animals, they have been silent victims of all kinds of cruelty. Therefore, it is necessary a series of public policies that guarantee the effectiveness of the protection of animals. This research is qualitative, with a descriptive-deductive method and its general objective is to analyze whether the protection against cruelty to animals is effective in the state of Sergipe. For this, we seek to analyze the doctrinal discussions in Brazil, on Animal Law, in the light of movements in defense of animals and the need for ethical reflection on the environment, which is not exclusive to human beings. We analyzed what the Federal Constitution (1988) says about animal rights; what do animal law scholars say; Brazilian animal protection legislation; the importance and scope of Law 14.064/2020, the performance and occurrences attended by the DEPAMA police station (Specialized Police Station for Animal Protection and the Environment). In this perspective, we question: Are the existence of animal protection laws and the aggravation of penalties for those who commit crimes against animals enough? What measures already exist and which can still be implemented in defense of animals in the state of Sergipe? These questions guide the present research, which aims to contribute to the topic in question.
