A linha tênue entre liberdade de expressão e discurso de ódio : como o ódio foi utilizado como ferramenta de manipulação política no governo Bolsonaro (2019-2022)

Abstract

The main theme of this research is Democracy and from its typification the fine line between freedom of expression and hate speech is studied, that is, how hate was used as a tool of political manipulation in the government of Jair Bolsonaro (2019-2022 ). And this is related to the fundamental rights and guarantees addressed in the Federal Constitution of 1988; aiming to clarify the limits of the right to expression of thought and whether or not hate speech is endorsed to be freely expressed and to achieve the proposed objective. Thus, the following steps were observed: 1. The behavior of the Brazilian legal system in regulating freedom of expression; 2. The way in which organized groups managed to manipulate and indoctrinate politically and in a negative way, common people and the public. The discussions were established mainly based on Hanna Arendt (1990) Meyer-Pflug (2009), Dworkin (2006), Karl Popper (1974). It is expected that hate speech will be fought, and that the State must intervene when demonstrations, guaranteed by the Federal Constitution, go from freedom to anti-democracy.
