Fanfiction, obra derivada, novas tecnologias e estado cultural

Abstract

Com as novas tecnologias, como as novas mídias e os novos meios de transmissão, o direito de autor como se conhece demanda um novo olhar sob a perspectiva dessa nova realidade. A nossa Constituição de 1988 consagra e recepciona a liberdade de expressão artística, porém, cabe à hermenêutica interpretá-lo quanto à natureza da arte, sua área e seu alcance. Neste raciocínio, o artigo trata de analisar a figura jurídica da obra derivada de fã – fanfiction, produto das novas eras midiáticas, nova forma de direito autoral em um Estado Cultural que terá que estar sempre atento aos interesses públicos e aos interesses privados no mundo jurídico._________________________________________________________________________________________ ABSTRACT: With new technologies, such as new media and new means of transmission, copyright as it is known demands a new look from the perspective of this new reality. Our Constitution of 1988 consecrates and welcomes the freedom of artistic expression, but it is up to the hermeneutics to interpret it as to the nature of art, its area and its scope. In this reasoning, the article tries to analyze the legal figure of the work derived from fanfiction, product of the new media era, a new form of copyright in a Cultural State that will have to be always attentive to public interests and private interests in the legal world._________________________________________________________________________________________ RÉSUMÉ: Avec les nouvelles technologies comme les nouveaux médias et de nouveaux moyens de transmission, le droit d'auteur que la demande rencontre un nouveau look dans la perspective de cette nouvelle réalité. Notre Constitution de 1988 consacre et se félicite de la liberté d'expression artistique, cependant, il est l'herméneutique interpréter la nature de l'art, sa superficie et la portée. Dans ce raisonnement, l'article est d'analyser le concept juridique de travail dérivé de fan - fanfiction, produit de nouvelles époques de médias, nouvelle forme du droit d'auteur dans un État culturel sera toujours attentif aux intérêts publics et intérêts privés dans le monde juridique.
