Resumo :	A influência do sistema do Common Law no processo civil brasileiro, que é regido pelo Civil Law, é inequívoca, seja pelo estabelecimento de um sistema de precedentes, que é previsto nos artigos 926 e 927 do Código de Processo Civil (CPC, 2015), seja pela edição dos enunciados de súmula vinculante ou pelos mandamentos insculpidos nos artigos 332, 932, 947 e 976 do mesmo diploma legal. O objetivo do presente trabalho de conclusão de curso é, então, abordar as principais características dos referidos sistemas, além de compreender a medida de influência de ambos no Direito brasileiro. Propõe-se, então, a apresentar reflexões práticas acerca da importância da uniformização do entendimento oriundo dos tribunais com o fito de conferir segurança jurídica aos jurisdicionados, além de celeridade processual e isonomia das partes perante o Poder Judiciário. Demais disso, analisam-se, também, as críticas referentes à referida uniformização, seja através da suposta ausência de separação dos poderes, limitação à independência judicial ou engessamento do entendimento dos tribunais. Sob essa ótica, concluise que a influência do Common Law no sistema brasileiro pode ser observada, dentro da limitação procedida neste trabalho, desde o século XX, com a disposição dos artigos 479 e seguintes do Código de Processo Civil de 1973, os quais versam sobre a uniformização jurisprudencial, ao passo que ganha robustez a partir da Emenda Constitucional nº 45/2004, que, dentre outras alterações, introduziu as súmulas vinculantes no ordenamento jurídico pátrio, e do CPC em vigência, responsável por estabelecer o sistema de precedentes no direito processual brasileiro. Desse modo, é possível conceber, no Brasil, a congruência entre os sistemas supramencionados, materializando-se não um sistema essencialmente híbrido, mas que evidencia a combinação de elementos de ambas as famílias jurídicas.
Abstract:	The influence of the Common Law system on Brazilian civil procedure, which is governed by Civil Law, is unequivocal, whether through the establishment of a system of precedents, which is provided for in articles 926 and 927 of the Code of Civil Procedure (CPC, 2015), or through the publication of binding summary statements or the commandments enshrined in articles 332, 932, 947 and 976 of the same legal diploma. The objective of this final course work is, therefore, to address the main characteristics of these systems, in addition to understanding the extent of their influence on Brazilian law. It is therefore proposed to present practical reflections on the importance of standardizing the understanding arising from the courts with the aim of providing legal certainty to those under its jurisdiction, in addition to procedural speed and equality of the parties before the Judiciary. In addition, criticisms regarding the aforementioned standardization are also analyzed, whether through the alleged lack of separation of powers, limitation of judicial independence or rigidity of the understanding of the courts. From this perspective, it is concluded that the influence of Common Law on the Brazilian system can be observed, within the limitation established in this work, since the 20th century, with the provision of articles 479 and following of the Code of Civil Procedure of 1973, which deal with the standardization of jurisprudence, while gaining strength from Constitutional Amendment No. 45/2004, which, among other changes, introduced binding summaries into the national legal system, and the CPC in force, responsible for establishing the system of precedents in Brazilian procedural law. In this way, it is possible to conceive, in Brazil, the congruence between the aforementioned systems, materializing not an essentially hybrid system, but one that highlights the combination of elements from both legal families.
