| Resumo : | Esta dissertação analisa a crescente integração da inteligência artificial (IA) na vida em sociedade e no sistema jurídico, examinando seus fundamentos ontológicos, hermenêuticos e teleológicos, bem como sua relação com os direitos fundamentais, especialmente à luz do humanismo integral de Jacques Maritain. Aqui, apresenta-se a evolução histórica e técnica da IA, singularizando suas fases, modelos e agentes, e discute-se o funcionamento dos algoritmos, o impacto de seu enviesamento e alguns resultados maléficos, tais como: a vigilância comportamental, as fake news e a crise epistêmica. Este estudo aborda ainda a necessidade de uma estrutura legal robusta para que a IA opere como uma ferramenta lastreada na axiologia normativa em vigor e não como um substituto do ser humano. Assim, para alcançar uma integração equilibrada e ética da IA, o estudo propõe diretrizes de constitucionalização da matéria e uma resposta interdisciplinar sobre o tema, com o objetivo de resguardar os direitos fundamentais à luz do metaprincípio da dignidade da pessoa humana. |
| Abstract: | This research examines how artificial intelligence (AI) is becoming increasingly embedded in social life and in the legal system. It explores the ontological, hermeneutic, and teleological foundations of AI and their relationship with fundamental rights, informed by Jacques Maritain’s integral humanism. The study traces the historical and technical development of AI, outlining its main phases, models, and agents, and analyzes how algorithmic functioning and structural bias can lead to harmful outcomes such as behavioral surveillance, fake news, and a deepening epistemic crisis. It argues that a robust legal framework is necessary to ensure that AI operates as a tool grounded in prevailing constitutional values rather than as a substitute for human judgment. To support an ethical and balanced integration of AI, the research proposes guidelines for the constitutionalization of the subject and an interdisciplinary response aimed at safeguarding fundamental rights under the overarching principle of human dignity. |
