| Resumo : | A presente dissertação discute o direito fundamental à educação a partir de uma abordagem jusliterária na obra Vidas Secas, de Graciliano Ramos. Ao explorar a interseção entre Direito e Literatura, a pesquisa de caráter interdisciplinar propõe compreender como a narrativa literária problematiza elementos culturais relativos ao direito à educação, abordando a desigualdade social brasileira, demonstrando a resiliência dos personagens sertanejos nordestinos e a necessidade de concretização do direito fundamental à educação como via indispensável para a realização de uma vida digna. Desse modo encontra-se vinculada à linha de pesquisa “Processo de Constitucionalização dos Direitos e Cidadania: Aspectos Teóricos e Metodológicos” dentro do campo dos estudos jusliterários ancorada na hermenêutica fenomenológica. A metodologia utilizada envolve a abordagem qualitativa fundamentando-se em revisão bibliográfica e jurisprudencial. Nesse sentido, visa contribuir através da crítica jusliterária em Vidas Secas para a discussão do direito fundamental à educação, articulando as relações entre memória, Constituição, democracia, cultura e desenvolvimento, a tempo em que problematiza as condições de concretização do direito à educação em face da realidade histórica jurídica cultural brasileira, analisando o cumprimento do Objetivo de Desenvolvimento Sustentável (ODS) nº 4 da Agenda 2030 da Organização das Nações Unidas (ONU), no Brasil, e o papel das decisões do Supremo Tribunal Federal (STF) em sede de Recurso Extraordinário (RE) sobre educação. Conclui-se que a obra Vidas Secas constitui um importante instrumento de reflexão jurídica e uma fonte hermenêutica constitucional, especialmente quando articulada à fenomenologia e à perspectiva cultural da Constituição. Por fim, constatou-se que as decisões do Supremo Tribunal Federal em sede de repercussão geral exercem papel relevante na efetivação desse direito fundamental, embora algumas ainda apresentem limitações quando analisadas à luz dos dilemas sociais retratados na narrativa. |
| Abstract: | This dissertation discusses the fundamental right to education from a legal-literary perspective in Graciliano Ramos's novel Vidas Secas. By exploring the intersection between law and literature, this interdisciplinary research seeks to understand how literary narrative problematizes cultural elements related to the right to education, addressing Brazilian social inequality, demonstrating the resilience of the characters from the northeastern hinterland, and the need to realize the fundamental right to education as an indispensable means to a dignified life. In this way, it is linked to the line of research “Process of Constitutionalization of Rights and Citizenship: Theoretical and Methodological Aspects” within the field of legal-literary studies anchored in phenomenological hermeneutics. The methodology used involves a qualitative approach based on a review of the literature and case law. In this sense, it aims to contribute, through legal criticism in Vidas Secas, to the discussion of the fundamental right to education, articulating the relationships between memory, the Constitution, democracy, culture, and development, while problematizing the conditions for the realization of the right to education in the face of Brazil's historical legal and cultural reality, analyzing the fulfillment of Sustainable Development Goal (SDG) No. 4 of the United Nations (UN) 2030 Agenda in Brazil and the role of the decisions of the Federal Supreme Court (STF) in an Extraordinary Appeal (RE) on education. It can be concluded that the novel Vidas Secas is an important tool for legal reflection and a source of constitutional hermeneutics, especially when linked to phenomenology and the cultural perspective of the Constitution. Finally, it was found that the decisions of the Federal Supreme Court in cases of general repercussion play a relevant role in the enforcement of this fundamental right, although some still present limitations when analyzed in light of the social dilemmas portrayed in the narrative. |
