Sexílio e acolhimento: o desafio para integração social dos refugiados lgbtqiapn+ no Brasil

Abstract

Refugee status based on persecution due to sexual orientation and gender identity, also known as sexile, is a global reality. The term was coined by Manuel Guzmán (1997) to address the situation of Latin American gays sent to the United States by their families because of their sexual orientation. Brazil, a signatory to the 1951 Convention and the 1967 Protocol, recognizes this refugee status and has internal legislation considered innovative. Given this scenario, this research investigated whether the Brazilian legal system has effective normative types and judicial interpretations to welcome and socially integrate refugees based on sexual orientation and gender identity, in light of Judith Butler's (2024b) concept of Precarious Lives. To this end, the hypothetical-deductive method was used, with a qualitative approach and bibliographic-documentary procedure. The results obtained confirmed the hypothesis that although Brazil presents, in its legal system and in the relevant judicial interpretations, a structured legislative framework, a factor that attracts people seeking refuge for many reasons, including sexual orientation and gender identity, there is no specific internal legislation and reception policies dedicated to maintaining these lives that are precarious, according to Butler's concept.
