O racismo religioso contra as liturgias de matriz africana : uma análise jurídica do direito à liberdade religiosa

Abstract

The purpose of this paper is to demonstrate that racism is part of the social structure of the Brazilian State, with religious racism being one of its most striking species. In order to achieve this objective, it’s discussed the theories about the relationship between the State and Religion within the sociological and political perspective. At first, the history of racial theories and their characteristics will be traced, as well as the way in which racism from these theories interfered and interferes in the expression of religious freedom. Then, the aspects of religious freedom are discussed as a political value and how these parameters are perceived in the legal field. It is also necessary to discuss the constitutional and legal evolution in a historical perspective of the presence and form that religious freedom and its species were treated, in addition to it’s relationship within the secularity of the State. Finally, also important is the jurisprudential analysis of some important points on the Extraordinary Appeal n. 494601, judged by the Federal Supreme Court, as well as a counterpoint to the arguments adopted by the defenders of the animal cause.
